Rafineria Gdańska is listed as a protected site. Other key companies are also on the list.
On Thursday, the State Legislative Center published a decision according to which, from January 1, 2023, Rafineria Gdańska will be included in the list of entities to be protected. Most likely, this means that it will be additionally protected from a possible hostile takeover or uncontrolled sale of shares by Saudi Aramco.
The list will also include Unimot, that is, the company that bought out part of the assets of Lotos during the merger of this concern with PKN Orlen.
Special list of companies
The addition of two entities to the list means that 15 enterprises will be included in the list of specially protected enterprises. The list of entities protected from hostile takeovers was created under the Control of Certain Investments Act, which came into force in October 2015.
The law states that a company operating in sectors identified as key has a significant market share, and its acquisition poses a serious threat to the fundamental interests of the state and is protected by the Ministry of State Assets.
Investors are required to inform the ministry about the planned purchase of shares in one of the strategic companies.
Orlen, Nitrogen, PKP Energetika
The list currently includes PKN Orlen, Emitel, Azoty Group, TK Telecom, Orange and KGHM. The list also includes PKP Energetika, a company that PGE plans to take over. On Wednesday, the Polish energy company announced that the deal is due to take place in April after certain conditions have been met, including approval from the head of the MAP and the WOKiK.
