In Transcarpathia, where a court had previously imposed a suspended sentence on three teenagers who had raped a schoolgirl, the court of appeal overturned this decision.
According to the Office of the Prosecutor General, during the trial, the prosecutors insisted on the annulment of the verdict of the court of first instance due to the leniency of the punishment and the full satisfaction of the civil claim for compensation for the victim of moral harm.
The representatives of the victim fully supported the position of the prosecutors. The interests of the girl in court were defended by some of the best lawyer associations, including lawyers who specialize in protecting victims of sexual violence.
“The Court of Appeal did not put an end to this case. According to the decision of the Transcarpathian Court of Appeal, the verdict of the first instance was canceled, and the case was sent for a new trial”, - the message says.
Recall that in March of this year, the Volovetsky District Court of the Transcarpathian region issued a verdict in criminal proceedings against three minors on the fact of sexual violence against a minor (part 3 of article 153 of the Criminal Code of Ukraine). They were sentenced to 5 years in prison and released from serving the sentence with a probationary period of 2 years and assigned certain duties to them. The court also partially satisfied the civil claim of the victim in the amount of UAH 450,000 and recovered UAH 180,000 in her favor.
