One of the projects awaiting consideration by the Seimas since February of this year is the acceleration of the payment of compensation benefits to road accident participants. This would be of great help to the victims of the bus accident with Polish pilgrims in Croatia, which took place over the weekend.
“The key decisions in this project are to speed up the procedure for payment of compensatory benefits by insurance companies and the introduction of a flat fee for claims for damages to health or induced health problems,” said Senator Krzysztof Kwiatkowski, head of the Senate. Legislative Committee.
Reduction of legal costs in disputes with the insurer
As the senator explains, the bus owner’s liability insurance payment is released only after the cause of the accident has been clarified. - It is common practice for insurance companies to suspend payment of compensation until the causes of the accident are clarified. This usually takes a long time. Our law introduces an obligation to pay an undisputed amount within 30 days. Therefore, the insurer will not be able to rely on what is waiting for clarification of the causes of the accident. The victims in Croatia will already need funds for rehabilitation, treatment, the arrival of the family in Croatia or return to Poland, the senator tells us.
Krzysztof Kwiatkowski adds that the families of accident victims can also claim compensation for the death of their relatives. - If someone claims a higher amount of compensation for himself or for the death of a loved one, he must pay legal costs of 5%. the cost of the dispute. These amounts are sometimes high, they can be several hundred or even several million zlotys. Therefore, in the project, we have introduced a fixed court fee of PLN 1,000. zloty. It is inhuman to demand huge sums of money from victims of road accidents, - the politician adds.
One of the projects is waiting for 870 days in the freezer
However, in a letter to Vitek, the senators demanded the adoption of all bills that are under consideration by the Seimas. Kwiatkowski recalls that the Senate has the same legislative initiative as the Seimas. - The difference is that the Senate must consider the initiative of the Seimas within 30 days, and if it does not, the bill is considered adopted without amendments. On the other hand, there are no deadlines. And Marshal Witek uses it extremely often, says Kwiatkowski.
Rzeczpospolita writes that for about 870 days the project for the unification of the Metropolis of Lodz has been awaiting consideration in the Sejm. This is one of the record holders, but there are more similar cases. There are four projects in progress with submissions over 800 days old. And those who have more than 700 days - ten.
- The thesis about fictitious consultations undermines the entire legislative system in Poland, since in most cases draft laws are sent for consultations to entities that, for example, sectoral laws grant the right to consider drafts (for example, lawyers and legal councils have them) - the Information Center of the Seimas answers. He adds that “some decisions are taking longer to work on due to the complexity of the issue” and some Senate proposals, such as those relating to Covid-19, “are no longer valid.”
