At the beginning of the large-scale Russian invasion, some convicts went to the front, in particular from the Tornado battalion, who were allowed to file a petition with the prosecutor’s office. Now, a draft law has been registered in the Verkhovna Rada, which proposes to allow some convicts to do military service during mobilization.
According to RBC-Ukraine, it is possible to cancel the measure of restraint for military service on conscription during mobilization, which can be used by suspects or defendants in criminal cases. However, the current legislation does not provide opportunities for convicts.
The authors of the document propose to allow the mobilization, at will, of convicts who have received sentences for corruption, violation of traffic safety rules or the operation of transport while under the influence of alcohol, drugs or other intoxication.
Military service is proposed to be allowed to people who have been sentenced through corrective labor; service restrictions for military personnel; restriction of freedom; imprisonment for no more than 5 years, if the court, taking into account the gravity of the criminal offense, came to the conclusion that it is possible to acquit the convicted person without serving the sentence.
It is proposed that permission to perform military service will be issued by the courts. Such convicts are offered either to be released from punishment, or to be carried to the term of service.
Recall that earlier the Verkhovna Rada extended the martial law and the general mobilization until February 19, 2023.
